وتنص المادة «الثانية» من نظام إدارة المواد الكيميائية على أنه لا يجوز استيراد المواد الكيميائية إلا بعد الحصول على إذن باستيرادها، ولا تفسح من الجمارك إلا بعد تقديم إذن فسحها. وتحدد اللائحة إجراءات طلب إصدار الإذن والنماذج الخاصة به وشروطه ومدته وكيفية تجديده وإلغائه.
متطلبات فسح المواد الكيميائية
وتلغي الهيئة إذن الاستيراد إذا استخدمت المواد المفسوحة لغير الغرض الذي استوردت من أجله، أو إذا منعت الجهة المستفيدة أو المستوردة من استيراد المواد الكيميائية، أو في حال تعديل أو تغيير بيانات أو نشاط الجهة المستوردة.
وحددت الهيئة متطلبات فسح المواد الكيميائية التي تدخل في صناعة المستحضرات الدوائية أو التجميلية أو الغذائية، والتي تتمثل في إذن الفسح، وإذن الاستيراد ساري الصلاحية، وفاتورة الشراء والاسم العلمي للمادة الكيميائية، ونشرة السلامة الكيميائية.
